SPECIAL EDUCATION IN THE PUBLIC SCHOOL SYSTEM

 

ROLE OF THE PUBLIC SCHOOLS

Public school systems must provide a free appropriate education for every person between 2 and 21 years of age inclusive, no matter how severe the disability.

 

If an appropriate public education is available to a student with disabilities and the parents choose to place him or her in a private school or facility, the school division is not required to pay for the child’s education.

 

SPECIAL EDUCATION SERVICES ARE PROVIDED TO POQUOSON CITY SCHOOLS STUDENTS AGES 2 THROUGH 21 INCLUSIVE WHO HAVE SPECIAL LEARNING NEEDS.

 

The Special Needs may include the following:

 

Autism - Language does not develop at  normal rate; repeats certain phrases or what is said; becomes upset if routine is changed; extreme resistance to change; does not play with toys the usual way; laughs at odd time; insensitive to pain; difficulty playing with children and responding to affection or discipline.

 

Traumatic Brain Injury - An injury to the brain caused by an external physical force, resulting in total or partial functional disability and/or psychosocial impairment.

 

Developmental Delays - Delays in the areas of cognitive abilities, motor skills, social/adaptive behavior, perceptual skills, and communication skills for children below age 9.

 

Emotional Problems - Difficulty getting along with peers, refuses to comply with rules; aggressive; moody for long periods of time; withdrawn; distractible; impulsive; often overreacts to common situations.

 

Orthopedic Impairments - Includes clubfoot; absence of arms or legs; poliomyelitis, cerebral palsy, fractures or burns which cause contracture.

 

Other Health Impairments - Limited strength vitality, and alertness due to chronic or acute health problems; and my include certain ADHD children.

 

Mental Disabilities - Slow in understanding information; difficulty solving simple problems; difficulty following directions; short attention span; unable to do grade level work; below average thinking and talking; acts younger than his/her age; dependent on others’ guidance.

 

Severe Disabilities - Severely impaired cognitive abilities, adaptive skills and life functioning; may have severe behavior problems; physical and/or sensory disabilities.

 

 

Learning Disabilities - Difficulty noting differences; difficulty remembering what is seen; difficulty learning the difference in sound-alike words; difficulty following a series of instruction; difficulty copying what the eye sees; difficulty recognizing the differences between left/right, up/down, early/late, etc; difficulty seeing letters in words and words in sentences.

 

Hearing Impairment - Has trouble hearing; asks speaker to repeat or talk louder; talks in very loud voice or very soft voice; favors one ear over the other; startles at sudden noise.

 

Visual Impairments - Frequently rubs eyes; squints; holds printed material close to eyes; eyes turn in; eyes frequently red or crusty.

 

Speech/Language Impairments - Speech is unclear or garbled; difficulty expressing wants; incomplete language structure; often needs instruction repeated.

 

HOW  MAY SPECIAL EDUCATION SERVICES BE PROVIDED BY A SCHOOL DIVISION?

... through home or hospital instruction,

... through other school divisions,

... in a state residential school, or

... by contract with a public or private agency.

 

WHAT RIGHTS ARE GUARANTEED?

All parents have a right to ...

... review their child’s records;

... consult frequently with school personnel concerning
    their child;

... request a review of placement;

... refuse a placement recommendation;

... participate in developing their child’s educational
    program; and

... have all records and services kept confidential.

in addition, both parents and school division have the right to appeal any decision made by either party.
